You’re welcome! I’m happy to be here. One of the absolute cornerstones of any solid estate plan is selecting an executor or trustee.

This individual, or entity if you choose a corporate trustee, will have the monumental responsibility of managing your estate after you pass away. They’ll be tasked with carrying out the instructions outlined in your will or trust, which could involve anything from paying debts and taxes to distributing assets to beneficiaries. Accordingly, choosing someone trustworthy, organized, and capable is paramount.

Moreover, it’s important to have open and honest conversations with this person beforehand about their role and responsibilities. Make sure they understand the scope of the job and are willing and able to commit the necessary time and effort. Remember, you’re entrusting them with a significant responsibility, so choosing wisely is essential.

I recall one instance where a client named their close friend as executor without fully discussing the intricacies involved. Unfortunately, this friend felt overwhelmed by the task and ultimately ended up making some decisions that weren’t in line with the client’s wishes. Had they had a more detailed conversation beforehand, this situation could have been avoided.

That’s why I always encourage my clients to carefully consider who they select for this crucial role and to communicate openly and honestly about their expectations.

Have there ever been any issues stemming from poorly chosen executors or trustees?

Absolutely. A mismatched executor or trustee can lead to a host of problems. Delays in administering the estate, disputes among beneficiaries, and even costly legal battles are all possibilities when the wrong person is at the helm.

It’s worth noting that according to a 2019 study by the AARP, nearly 60% of Americans don’t have a will or trust in place. This means that many families face unnecessary stress and complications during an already difficult time.

What advice would you give to someone who is unsure about who to choose as an executor?

It’s understandable to feel uncertain. My advice is to consider several factors: trustworthiness, organizational skills, financial literacy, and the ability to handle sensitive family matters.

You could also create a list of potential candidates and discuss their strengths and weaknesses with them directly.
