Probate is essentially a court-supervised process for distributing a deceased person’s assets according to their will or state law. It can seem complicated, but it ensures everything is handled legally and fairly.

What are some key steps in the probate process?

There are several crucial steps involved. One of the most important early stages is ‘Marshaling the Estate Assets.’ This involves identifying and inventorying all assets belonging to the deceased, which can include everything from bank accounts and real estate to personal property.

Can you elaborate on why accurately marshaling assets is so critical?

It’s fundamental for a couple of reasons. Firstly, we need a complete picture of what the estate comprises to determine if probate is even necessary in the first place. Remember, estates valued under $184,500 may bypass probate altogether. Secondly, an accurate inventory ensures that all assets are accounted for and distributed properly according to the will or intestacy laws.

Ordinarily, this process involves working closely with the executor or administrator, who is responsible for gathering documentation like bank statements, deeds, titles, and insurance policies. We also utilize appraisal services to determine the fair market value of assets, particularly real estate and valuable personal items. Consequently, this meticulous approach helps avoid any disputes later on.

Notwithstanding these best practices, there have been times when we’ve encountered unforeseen challenges. I recall one instance where a client’s family discovered a hidden safe deposit box containing a significant amount of cash. This discovery required us to amend the inventory and adjust the distribution plan accordingly. While it added complexity, it ultimately ensured that all beneficiaries received their rightful share.

A recent study by the National Academy of Elder Law Attorneys found that approximately 70% of estates require probate. This highlights the importance of having a knowledgeable attorney guide you through the process and address any potential issues that may arise.
