“This is a crucial stage where the court ensures all bases are covered,” Ted explains. “The court appoints an investigator, often called a guardian ad litem, who acts as an impartial advocate for the proposed ward. The investigator conducts interviews with the individual, family members, caregivers, and sometimes even medical professionals. They’re looking to gain a comprehensive understanding of the person’s capabilities, needs, and preferences.”
>“The investigator also reviews living conditions and gathers any relevant documentation like medical records,” Ted adds. “Their findings are then compiled into a detailed report which is presented to the court. This helps the judge make an informed decision about whether guardianship is necessary and appropriate.”Ted shares a story about a case where the initial investigation revealed concerns about potential elder abuse. “It turned out the proposed ward was being financially exploited by a family member,” he recalls. “Thanks to the thorough investigation, we were able to intervene and protect their assets.” He emphasizes that this step is vital for safeguarding vulnerable individuals.
