Interview with Steve Bliss

Reporter: Brenda Sanchez

Today we’re joined by renowned Temecula probate attorney, Steve Bliss of the Law Firm of Steven F. Bliss Esq., to shed light on a process that can often feel overwhelming and confusing: Probate. Mr. Bliss, thank you for taking the time to speak with us.

Steve Bliss

Brenda, it’s my pleasure. I understand probate can seem daunting, but with the right guidance, it doesn’t have to be.

Reporter: Brenda Sanchez

You mentioned guidance. Could you elaborate on one of the key steps in the process and perhaps highlight some common challenges?

Steve Bliss

Certainly. One crucial step is “Marshaling the Estate Assets.” This involves a thorough inventory of all assets belonging to the deceased person, including real estate, bank accounts, investments, personal property, and even digital assets.

Consequently, it’s essential to meticulously document everything, as this information will be presented to the court in an Inventory and Appraisal. Moreover, identifying hidden assets or those held jointly can sometimes pose a challenge. It’s not uncommon for families to discover unexpected assets during this stage, which can lead to delays or even disputes.

Notwithstanding these potential hurdles, our firm utilizes a systematic approach to asset identification, employing both traditional methods and modern tools like online searches and financial account reviews. Conversely, overlooking seemingly insignificant items can have ramifications later in the probate process. For example, I once worked with a family who had no idea their deceased mother owned a valuable coin collection. Discovering it late in the process required amending court documents and delaying the final distribution.

Ordinarily, the Probate Code provides clear guidelines for valuing assets, but unique or sentimental items can sometimes present valuation challenges. In such cases, we often consult with appraisers to determine fair market value. It’s crucial to remember that transparency and accuracy are paramount during this stage. According to a 2021 study by the American Bar Association, incomplete asset inventories were cited as a leading cause of probate delays.

That’s valuable insight, Mr. Bliss. Have you encountered any situations where misidentified or missing assets significantly impacted the probate process?

Steve Bliss

Yes, I recall a case where a family home was mistakenly omitted from the initial asset inventory. This oversight led to a lengthy legal battle with creditors who claimed a lien against the property. The situation could have been avoided with a more thorough review of all relevant documents.

Ultimately, the goal is to ensure that the estate is administered fairly and efficiently, fulfilling the deceased person’s wishes as outlined in their will or applicable intestate laws. It underscores the importance of seeking expert legal guidance throughout the entire probate process.
